Welcome to cassidydickens.com (the "Website"). By accessing or using this Website, purchasing merchandise, subscribing to my newsletter, registering for events, or otherwise engaging with my content and services, you agree to be bound by these Terms and Conditions ("Terms").

Please read these Terms carefully. If you do not agree to these Terms, you must not use the Website or any of the services offered.

These Terms apply to all visitors, users, and others who access or use the Website, and are operated by Cassidy Dickens ("I," "me," or "my"), a sole proprietor doing business as Lyric Creative and Lyric Creative Co.

All content on this Website, including but not limited to text, graphics, logos, images, audio recordings, videos, and software, is the property of Cassidy Dickens or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website, except as follows:

  • You may download or print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use

  • You may share content on social media platforms using provided sharing tools

  • You may not use any content from this Website—including but not limited to music, lyrics, audio recordings, text, articles, images, photographs, videos, or other creative works—to train, develop, or improve artificial intelligence systems, machine learning models, large language models, generative AI tools, or any other automated systems without my express written permission. This prohibition includes scraping, crawling, mining, or otherwise extracting content for the purpose of AI training, model development, or any commercial or non-commercial AI application. Violation of this provision is a material breach of these Terms and may result in legal action.

  • You must not modify copies of any materials from this Website or delete or alter any copyright, trademark, or other proprietary rights notices.

4. Merchandise and Digital Products

A. Orders and Payment

All orders placed through the Website are subject to acceptance and availability. I reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Prices for merchandise and digital products are listed in U.S. dollars and are subject to change without notice. Payment must be made at the time of purchase through the available payment methods (Stripe, Square, PayPal, Bandcamp, or Patreon).

B. Shipping and Delivery

I will make reasonable efforts to ship physical merchandise in a timely manner. However, I am not responsible for delays caused by shipping carriers, customs processing, or other factors beyond my control.

Digital products (such as music downloads) will be delivered electronically via email or download link. It is your responsibility to ensure that your email address is correct and that you can access the download link.

C. Returns and Refunds

Due to the nature of physical merchandise (CDs, vinyl, apparel, etc.) and digital products (music downloads, online content), all sales are final. I do not offer refunds or exchanges except in the following circumstances:

  • If merchandise arrives damaged or defective, please contact me within 7 days of receipt at hello@cassidydickens.com with photos of the damaged item. I will work with you to provide a replacement or refund.

  • If you do not receive your digital product within 48 hours of purchase, please contact me at hello@cassidydickens.com and I will resend the download link.

D. Event Registrations and Retreats

Registration fees for events, workshops, and retreats are non-refundable except in the case of event cancellation by me. If I cancel an event, you will receive a full refund of your registration fee.

If you are unable to attend an event after registering, you may transfer your registration to another person with prior written notice to me at hello@cassidydickens.com.

5. User-Generated Content

The Website may allow you to post comments, submit content, or otherwise contribute material ("User Content"). By submitting User Content, you grant me a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with the Website and my business.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content

  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights

  • Your User Content does not contain defamatory, obscene, or otherwise unlawful material

I reserve the right to remove any User Content that violates these Terms or that I deem inappropriate, without notice.

6. Third-Party Links and Services

The Website may contain links to third-party websites, services, or platforms, including but not limited to Spotify, Apple Music, Instagram, Facebook, Bandcamp, Patreon, and YouTube. These links are provided for your convenience only.

I have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that I am not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any third-party websites or services.

7. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

I DO NOT WARRANT THAT:

  • The Website will be available at all times or will function without errors or interruptions

  • The content on the Website is accurate, complete, or current

  • Any defects in the Website will be corrected

  • The Website is free of viruses or other harmful components

8. Limitation of Liability

These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Website shall be resolved exclusively in the state or federal courts located in Randolph County, West Virginia, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding your use of the Website and supersede all prior agreements and understandings.
